PROP 65 WARNING RELEASE

Because your order is shipping to the state of California, we are required to obtain a release from you regarding Prop 65 before we can process your order.  If you are not already aware of Prop 65, please read the information sheet that goes with every order shipped to California, called Why is this Sticker on My Bottle?

Moss Nutrition Products, Inc. cannot verify that substances mandated by Proposition 65 in the state of California are either not in products sold by Moss Nutrition Products, Inc. or are in products sold by Moss Nutrition Products, Inc. at levels that satisfy the requirements of Proposition 65.   Therefore, as mandated by Proposition 65, we issue the following warning for all products that are shipped to end-users in the state of California:

The team at Moss Nutrition Products, Inc. ("Moss Nutrition") are delighted that Patients and Practitioners ("You") have decided to use our website  ("Website").  

      These Terms of Use contain the terms under which Moss Nutrition provides our website to you. You indicate your agreement to these Terms of Use by using the website and logging in to your accounts.   

      Agreement to these Terms of Use includes agreement to the Privacy Policy  

  1. Definition. "User Data" means all data and information that you input into the website. 
  1. Provision of Website. Moss Nutrition makes the website available to you pursuant to these Terms of Use. During the Term, Moss Nutrition grants you a worldwide, non-exclusive, non-transferable, non-sub licensable right to access and use the website, all subject to and in accordance with these Terms of Use. The website is hosted by Moss Nutrition and will be accessible by you over the Internet.    

      The website may contain content developed by third parties and provided to us under license.  You agree to respect the rights of the third parties in this content’s intellectual property, such as restrictions on copying and use, even though such rights may be specific to certain material.  You shall assure that any notices such as copyright notices are retained in connection with such material. 

  1. Your Responsibilities. (a)   Access. You are responsible for preventing unauthorized access to the website. If you learn of any unauthorized access, you will notify Moss Nutrition promptly of any such unauthorized use. You are responsible for all hardware, Internet service and other items necessary for the access and use of the website. 

      (b) Compliance with Law. You will comply with all applicable laws in using the website, including all legal requirements in collecting data from individuals.  

      (c)   Your Data. You are solely responsibility for all aspects of the your data, including but not limited to the accuracy, quality, integrity, legality, reliability, and appropriateness of such data. 

      (d)   Cooperation. You will provide access and/or support to Moss Nutrition personnel for purposes of administering and configuring the website and troubleshooting any problems relating to the website as is necessary for the website to function properly. 

      (e}   Copies. The website is protected by U.S. and international copyright and trade secret laws and treaties. You may print and make copies of the materials regarding the website, including product technical sheets and product information for any use not prohibited by applicable law. All such copies must include all of Moss Nutrition's proprietary notices contained in the originals without alteration of any kind. 

      (f)   Reverse Engineer. You may not cause or permit any third party to modify, reverse engineer, or create derivative works based on the website. 

      (g)   Misuse. You may not misuse our website by, among other things, interfering with its normal operation, attempting to access the website by using a method other than through the interfaces that we provide.  

  1. Ownership of the Website. Moss Nutrition does not sell the website to, but only grants you a license to use the website according to these Terms of Use. Moss Nutrition and its licensors retain ownership in the website and all intellectual property rights in the website, including without limitation: patents, copyrights, trade secrets, trademarks and any other proprietary and other rights. All rights not specifically granted under these Terms of Use are reserved by Moss Nutrition and its licensors. 
  1. Feedback. You retain ownership of all its intellectual property rights in Your data. Moss Nutrition does not claim ownership over any of Your data. You grant Moss a worldwide, royalty free license to use, reproduce, distribute, modify, adapt, create derivative works, make publicly available, and otherwise use Your User Data, but only for the limited purposes of providing and improving the Website to you and in aggregate or de-identified form only to other users, for research for the field and as otherwise permitted by our Privacy Policy  As further explained in the Moss Nutrition Privacy Policy, unless required by applicable law, Moss Nutrition will not disclose to any third party any personally identifiable information contained in Your data without explicit permission. This license for such limited purposes continues even after You stop using the Website. This license also extends to any trusted third parties Moss Nutrition works with to the extent necessary to provide the Website to You. If You provide us with feedback about the Website, Moss Nutrition may use your feedback without any obligation to You.  
  1. Privacy and Security.   (a)  Moss's Privacy Policy explains how Moss Nutrition treats your User Data. You agree that Moss Nutrition may use and share Your data only in accordance with these Terms of Use and our Moss's Privacy Policy.  

      (b)   Moss Nutrition will store and process Your data in a manner consistent with industry security standards. Moss Nutrition has implemented technical, organizational, and administrative systems, policies, and procedures to help ensure the security, integrity, and confidentiality of Your data and to mitigate the risk of unauthorized access to or use of Your data. 

      (c) Moss Nutrition complies with applicable Federal and state civil rights laws and does not or discriminate on the basis of race, color, national origin, language, culture, ethnicity, age, religion, sex, mental or physical disability, sexual orientation, gender expression, gender identity, veteran status, socioeconomic status, or any other characteristic prohibited by federal, state, or local law.

Shipping cut off time

Generally, orders received by 3:00 PM EST on Monday through Friday will be shipped the same day.

Standard shipping

Allow 3-10 days for delivery. Standard shipping may be First Class Mail (packages under approx 12 oz), Priority Mail or UPS ground.  Note: UPS may require a signature for proof of delivery - your delivery driver will make that decision. If the driver wants a signature, and there is no one to receive the package on the first try, UPS will make 2 more attempts to deliver, after which the package will be shipped back to us.  UPSP may also require a signature, driver discretion.

International Shipping Policy

Orders shipping outside of the U.S. will be charged published shipping rates based on the declared value and weight of the package. Certain customs regulations may apply regarding transit times and additional fees. Though we do our best to be informed of any regulations and to ensure the safe arrival of your package, due to the unpredictable nature of shipping internationally and potential for uncontrollable circumstances, we cannot guarantee timely shipment to International addresses. Any item mailed to another country may be subject to Goods and Services Tax and/or Duty fees at customs. These additional fees are typically calculated based on the value of the order. Awareness and payment of any customs charges is the responsibility of the customer.

State Sales Tax

A 6.25% State Sales Tax will be applied to orders shipped to Massachusetts addresses. This includes orders held for customers to pick up at our location.

Back Orders

Orders that have 1 or more back ordered items will not be shipped the same day if any of the back ordered items are expected within 3 days. In this case we will notify you by email or by telephone and ship the order complete when we receive the back ordered item(s). When an order contains a back ordered item(s) that are expected after 3 days, we will ship the in-stock items right away and charge you only for those items that are sent. When the back ordered items are shipped, we will charge you for those items with no additional shipping charge.

Return Policy

All returns must first be authorized by Moss Nutrition, and a reason is required. Please contact us for a Return Authorization Number (RMA) at (800) 851-5444 or info@mossnutrition.com.  Returns must be resalable - the outer plastic safety seal must be in place, with no markings on the bottle. Returns must be made within 30 days of the invoice date and are subject to a 15% restock fee. See Return Policy document that will be included with your order.

Damaged or missing items

Packages delivered in damaged or incomplete condition MUST be reported to our office within 48 hours of receipt. Please retain the original shipping carton for UPS or USPS examination. Following their inspection of the package, UPS or USPS will pick-up the damaged product(s) and handle all details on the claim, notifying us.  Please do not return damaged packages to us.
